1. Parties and Acceptance These Terms of Service ("Terms") govern your access to and use of the CMeIn website, application, services, generated images, accounts, credits, and related features (together, the "Service"). The Service is operated by CMeIn, located at Tel Aviv District, email: support@cmein.com ("CMeIn", "we", "us", or "our").
By creating an account, signing in with Google, uploading images, purchasing credits, requesting generations, or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You may not use the Service if you are prohibited from doing so by law.
3. What the Service Does CMeIn allows users to upload reference images and request AI-generated profile-style photos based on prompts, examples, scenes, and other instructions. Results are generated by automated systems and third-party AI providers. Output quality may vary between generations.
4. Account Creation and Google Sign-In You may create an account using email/password or Google sign-in, when available. When signing in or signing up with Google, we may receive and store information such as your email address, name, profile identifier, and other information Google provides according to your Google permissions and our configuration.
You are responsible for keeping your account secure. You must not share access credentials or use another person's account without permission.
5. User Content and Image Uploads "User Content" means images, selfies, photos, prompts, text, location data, comments, messages, and any other content you upload or submit to the Service.
By uploading User Content, you confirm that: - You upload only photos of yourself, or of a person who has given you their explicit, informed consent to upload their image and to generate AI images of them using the Service. - You own the content or have all rights and permissions needed to upload and use it. - The people shown in uploaded images have consented to that use, where legally required. - The content does not violate privacy, publicity, intellectual property, consumer protection, or other rights. - You will not upload photos of any person under 18, of any private individual, or of any third party without that person's consent and all required legal rights.
Reporting and takedown. If you believe an image or upload depicts you (or someone you represent) without consent, or otherwise violates these Terms, email support@cmein.com. We aim to review reports promptly and may remove violating content, suspend or terminate accounts, and report illegal content to the authorities.
6. Selfies and Recommended Reference Images Selfies and low-quality reference photos are not recommended. If you upload selfies, mirror selfies, heavily filtered images, face-obscured images, sunglasses/hat-covered images, blurry images, or photos with poor lighting, you understand that the generated image may not closely match you. In such cases, CMeIn may decline to provide additional retry credits under the likeness policy. Retry credits, when granted, are credits for another generation attempt and are not cash refunds.
Using selfies or low-quality reference images may reduce similarity and quality. CMeIn is not responsible for poor results caused by unsuitable reference images. For best results, use clear, natural photos taken by another person, with good lighting, visible face, limited filters, normal camera distance, upper-body framing, and multiple angles that match your current appearance, including beard, hair, age, and body.
Identity verification. To keep accounts honest and protect people from misuse, CMeIn may require you to take a live selfie so we can confirm you are the person shown in your uploaded reference photos before generating images. By using verification, you consent to this biometric face comparison, which may be performed by automated systems and/or by manual review. We retain your most recent verification selfie so our team can review it and approve or revoke your verification; we keep only the latest selfie, and you may request its deletion by emailing support@cmein.com. Verification may be revoked, and generation blocked, if your reference photos change or no longer match.
7. Similarity, Quality, Credits, Retries, and No Refunds AI-generated image similarity is subjective and cannot be guaranteed. CMeIn does not promise perfect identity matching, exact facial reproduction, or a specific artistic result.
Generation controls — including subject-size sliders, "blend in other people" or similar background-people toggles, scene/style selections, typed ideas, and any other parameter you choose before generating — are guidance to the AI model, not strict commands. The model may interpret them loosely, partially, in modified form, or not at all. A result that does not exactly honor a chosen control, toggle, slider value, or prompt parameter is not by itself grounds for refund or retry credit.
If a generated image does not reasonably resemble the person shown in your uploaded reference photos, as reasonably determined through CMeIn's support review process, your sole remedy is a credit for one additional retry, not a cash refund. The assessment of likeness is inherently subjective and is not a scientific, biometric, or mathematically precise measurement. The retry credit may be limited to the same prompt/category, account, and reasonable time period. The likeness retry-credit policy does not apply when poor or selfie-based reference photos are the reason for low likeness. CMeIn may refuse a retry credit if the issue was caused by low-quality reference images, selfies, mirror selfies, unclear face visibility, heavy filters, sunglasses, hats, poor lighting, misleading prompts, policy violations, or misuse. Retry credit is at CMeIn's discretion.

Per-account refund cap. Discretionary refunds and retry credits granted for generation-related grievances are limited to a maximum of three (3) per account, lifetime. This includes any combination of: cash refunds at CMeIn's discretion for consumed credits, retry credits granted under the likeness policy above, customer-service goodwill credits, and discretionary partial refunds for any other reason. After three such discretionary remedies have been granted, CMeIn may, where reasonably necessary to prevent repeated misuse, abuse, or recurring generation-related disputes, restrict the account from making additional purchases or generations, and may decline any further discretionary refund or retry credit. The cap does not apply to (a) 14-day cooling-off refunds for unused credits, (b) 24-hour refunds for unactivated location locks, (c) non-waivable consumer-protection law refunds, or (d) refunds for CMeIn's own technical failures. See the Refund Policy for full details.
Credits, generation purchases, location locks, premium features, and digital services are generally non-refundable unless a refund is required by applicable law or expressly approved by CMeIn in writing.
8. Credits and Paid Features Credits are a digital balance used inside the Service. Credits have no cash value, are not a bank account, are not transferable unless we allow it, and may expire or be adjusted according to Service rules published by CMeIn.
All prices, credit packages, and refunds on CMeIn are denominated in US Dollars (USD), regardless of the local currency your payment processor (such as Tranzila) displays for your convenience. Your payment processor or bank may apply a currency-conversion rate when charging your local-currency account, and a separate conversion rate when refunding it; CMeIn is not responsible for differences between the USD amount and your final local-currency settlement.
Minimum purchase. The smallest paid credit pack on CMeIn is 300 credits at a price of approximately three US Dollars (USD 3.00). The standard exchange is 1 credit ≈ USD 0.01. Larger packs may be offered at the same or a discounted per-credit rate. Exact prices and pack sizes are shown at checkout and may change from time to time.
Free credits and photo visibility. CMeIn may grant free credits (welcome bonus, referral bonus, free-tier monthly grant, or promotional credits). Photos generated with free credits carry no visibility restriction: like photos generated with paid credits, they are PRIVATE by default and you may set them PUBLIC or PRIVATE at any time, as often as you like, without any additional charge. A photo appears in the public feed and on your public profile only while you have chosen to publish it.
Prices, credit costs, packages, and features may change from time to time. Payment processing may be handled by third-party providers such as Tranzila, Stripe, Google Pay, Apple Pay, or other payment processors.
9. Location Locks and Exclusivity Features If the Service offers location locks, radius locks, or similar features, these features are intended to reduce duplication of similar generated concepts in a defined location range. They do not guarantee legal exclusivity, full market exclusivity, dating success, or that no similar images will ever exist.
10. Prohibited Uses You may not use the Service to: - Upload photos of, or generate images of, any real person without their consent. - Impersonate another person or create misleading identity content without consent. - Create or upload sexual, intimate, nude, or non-consensual imagery of a real, identifiable person — including face-swap or "deepfake" sexual content — with or without that person's consent. - Place an identifiable person in a setting, act, or context that a reasonable person would find defamatory, humiliating, or harmful, or that falsely implies illegal, criminal, hateful, or compromising conduct. - Create illegal, abusive, harassing, hateful, sexual, exploitative, defamatory, or privacy-invading content. - Upload content involving minors, or sexualize or depict anyone under 18, without lawful authority and consent. - Violate intellectual property rights or publicity/privacy rights. - Remove or obscure any label, watermark, or signal indicating that an image was AI-generated. - Reverse engineer, scrape, overload, attack, or bypass technical limits of the Service. - Use generated images for unlawful, deceptive, fraudulent, or harmful purposes.
11. Data We Collect Depending on how you use the Service, we may collect and process: - Account data: name, email, login method, Google account identifiers, role, authentication metadata. - Uploaded content: reference images, source images, generated images, prompts, keywords, and related files. - Generation data: selected prompt, AI provider, model/deployment/version, generation status, errors, timestamps, and usage history. - Payment data: product purchased, credits, transaction records, payment status, payment processor identifiers. Full payment card data is normally handled by the payment processor, not stored directly by us. - Location data: browser GPS, estimated city/region/country, GPS accuracy, and lock radius where location features are used. - Technical data: IP address, device/browser information, logs, cookies/local storage, security events, API requests, and analytics data. - Communications: contact messages, support requests, inbox notifications, and related correspondence.
12. Why We Use Data We use data to: - Provide, operate, and improve the Service. - Authenticate users and secure accounts. - Generate images and manage uploaded/reference images. - Process payments, credits, purchases, and refunds where applicable. - Provide support, retries, notices, and administrative tools. - Prevent abuse, fraud, security incidents, and policy violations. - Comply with legal, tax, accounting, consumer protection, accessibility, and privacy obligations. - Analyze performance and improve product quality.
13. Sharing Data with Third Parties We may share data with trusted service providers needed to operate the Service, including hosting providers, storage providers, AI providers, payment processors, analytics/logging providers, email providers, security tools, and professional advisors. These providers may process data in Israel or other countries.
When you request image generation, your uploaded images and prompts may be sent to third-party AI services for processing. Do not upload content if you do not want it processed by such providers.
We may also disclose information if required by law, court order, regulator request, to enforce these Terms, to protect rights and safety, or in connection with a business transfer.
14. Data Retention and Deletion We keep data for as long as needed to provide the Service, maintain security, comply with legal obligations, resolve disputes, enforce agreements, and keep business/accounting records. You may request deletion of your account or certain content by contacting Support@CMein.com Some records may be retained where required for legal, tax, fraud prevention, backup, security, or dispute-resolution purposes.
User Responsibility to Download Content: Users are responsible for downloading and saving their own uploaded and generated images. CMeIn may rely on third-party hosting, storage, infrastructure, AI providers, and other service providers. We do not guarantee that uploaded images, generated images, prompts, messages, account content, or related data will remain available permanently. To the maximum extent permitted by law, CMeIn is not responsible or liable for loss, deletion, corruption, unavailability, or failure to retrieve any user content, including where caused by third-party service providers, hosting/storage providers, technical failures, maintenance, security incidents, account issues, or data loss. Users should keep their own backup copies of any content they want to preserve.
15. Privacy and Israeli Law CMeIn is intended to operate with attention to privacy obligations, including Israeli privacy requirements where applicable. The right to privacy is recognized under Israeli law, including the Protection of Privacy Law, 5741-1981 and related privacy/data-security requirements. Depending on the size, sensitivity, and use of the database, additional obligations may apply, including registration or notification duties.
16. Security We use reasonable technical and organizational measures designed to protect data. However, no online service, AI provider, storage system, or transmission is completely secure. You use the Service with this understanding.
17. Generated Content Rights Subject to payment, account standing, these Terms, and third-party provider rules, you may use generated images for lawful personal purposes, including dating profile use. CMeIn does not guarantee that generated outputs are unique, copyrightable, non-infringing, platform-approved, or accepted by any third-party website/app.
18. No Guarantee of Dating Results CMeIn does not guarantee matches, dates, messages, popularity, acceptance by dating platforms, or social success. The Service provides image generation tools only.
19. Service Availability and Changes We may modify, suspend, limit, or discontinue all or part of the Service at any time. We may change prompts, models, providers, prices, credits, lock rules, admin settings, UI, or features.
20. Termination We may suspend or terminate accounts that violate these Terms, create legal risk, misuse the Service, avoid payment, upload prohibited content, or harm the Service or other users.
21. Disclaimers The Service is provided "as is" and "as available". To the maximum extent permitted by law, CMeIn disclaims warranties of accuracy, similarity, fitness for a particular purpose, uninterrupted availability, merchantability, non-infringement, platform acceptance, and error-free operation.
AI-Reduction ("Anti-AI") Downloads: Some generated photos can be downloaded in an "Anti-AI" version, which applies optional processing intended to make the image read as less obviously AI-generated to automated AI-image detectors (such as those some dating or social platforms may run). If you intend to post a generated photo to a dating app or similar platform, the Anti-AI download is generally preferable to the standard download for this purpose. IMPORTANT: this is a best-effort REDUCTION only. It lowers, but does NOT fully or reliably remove, the signals that an image was AI-generated, and it does not work the same way on every image. CMeIn does not warrant or guarantee that an Anti-AI download will avoid detection, pass any particular detector, or be accepted by any platform; detection technology changes over time and results vary. The standard (non-Anti-AI) download retains the image's full AI characteristics. You remain solely responsible for complying with the terms, policies, and any AI-generated-content rules of every platform on which you post images.
22. Limitation of Liability To the maximum extent permitted by law, CMeIn will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages. CMeIn's total liability for any claim related to the Service will be limited to the amount you paid to CMeIn for the specific generation or feature giving rise to the claim, or the minimum amount required by applicable law, whichever is higher.
23. Indemnity You agree to defend, indemnify, and hold harmless CMeIn, its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the Service, your violation of these Terms, or your violation of any rights or laws.
24. Consumer Rights Nothing in these Terms limits non-waivable rights you may have under applicable consumer protection laws. If any term is found unenforceable, the remaining terms continue to apply.
25. Governing Law and Jurisdiction These Terms are governed by the laws of the State of Israel, unless mandatory law requires otherwise. Subject to applicable law, courts in Israel will have jurisdiction over disputes related to the Service.
26. Changes to These Terms We may update these Terms from time to time. The updated version will be posted on the website with a new "Last updated" date. Continued use of the Service after updates means you accept the updated Terms.
27. Non-Compete and Restriction on Copying By using this Service, you agree not to copy, clone, replicate, adapt, reverse-engineer, or build a competing service based on CMeIn's product, user experience, generation flows, prompt logic, business model, or internal materials, whether directly or through a third party.
This restriction applies to users, experts, partners, contractors, collaborators, and any person who has accessed the Service or internal materials in any capacity. It does not prevent you from using competing services that you had no part in creating.
CMeIn's prompt logic, generation workflows, example outputs, administrative tools, and product design are proprietary. Reproducing or substantially imitating these materials — in whole or in part — for commercial or competitive purposes is prohibited.

28. Anti-Scraping, Data-Mining, and Anti-Detection Restriction (Dating Platforms and Others) This Section applies to any third party that accesses or obtains content from the Service, including — without limitation — dating websites and dating applications, their operators, owners, affiliates, contractors, vendors, agents, data partners, or any person or automated system acting on their behalf or for their benefit (each, a "Restricted Party"). Accessing, crawling, or collecting from the Service constitutes acceptance of this Section, whether or not the Restricted Party holds an account or clicked to accept these Terms.
No scraping or harvesting. You and any Restricted Party may not scrape, crawl, spider, scroll, index, bulk-download, cache, mirror, or otherwise collect, copy, or extract images, photos, generated outputs, thumbnails, prompts, or metadata from the Service, whether manually or by any automated means, bot, script, headless browser, or AI agent.
No training or anti-detection use. You and any Restricted Party may not use — and may not enable, fund, procure, or assist any other party to use — any image or content obtained from the Service to train, fine-tune, build, evaluate, or improve any model, classifier, detector, fingerprint, perceptual hash, hash database, watermark detector, dataset, or system whose purpose or effect is to identify, label, flag, fingerprint, downrank, restrict, block, ban, or otherwise prevent CMeIn-generated images — or the users who post them — from being used on or accepted by any platform, including dating platforms. Any effort to "learn" or catalogue CMeIn's images in order to deny CMeIn's users the ability to use those images is expressly prohibited.
Liquidated damages of USD $450,000,000. CMeIn's images, generation outputs, and the goodwill of its users are uniquely and substantially valuable, and the harm caused by a breach of this Section is real but difficult to quantify in advance. Accordingly, each Restricted Party (and any party) that engages in, attempts, procures, funds, or assists any activity prohibited by this Section agrees to pay, as liquidated damages and not as a penalty, and without any requirement that CMeIn prove or quantify actual damage or loss, four hundred fifty million United States dollars (USD $450,000,000) per breaching program, campaign, dataset, model, or system, to CMeIn or — at CMeIn's sole election — to CMeIn's owners and shareholders. This amount is a good-faith pre-estimate of the harm and is in addition to, and not in lieu of, CMeIn's rights to injunctive and equitable relief, to actual damages where greater, and to recover all costs and reasonable legal fees. Each Restricted Party consents to immediate injunctive relief to stop a breach without the need to post bond.
This Section survives termination of your account or these Terms and applies regardless of whether the Restricted Party accessed the Service directly, anonymously, or through an intermediary.
29. Transactional Emails and Consent By creating an account, you consent to receive transactional emails from CMeIn about your account, including: confirmation of account creation, security notices and login alerts, password reset requests, account deletion confirmation, payment receipts, refund notifications, and material changes to these Terms or the Privacy Policy.
You will not receive promotional or marketing emails unless you separately opt in. You may opt out of optional notifications via your Account settings, but you cannot opt out of security-critical and legal-compliance emails for as long as your account remains active. The only way to stop these emails entirely is to delete your account.
We send email via Azure Communication Services from the verified address support@cmein.com (or a subdomain we control). Email delivery is best-effort: CMeIn is not responsible for emails blocked or filtered by your provider.

31. Scope of Sections 31-41 Sections 31 to 41 supplement the sections above and form part of these Terms. Where a section in this part addresses the same subject as an earlier section, the two are read together; where an earlier section states a more specific rule for a specific situation, that more specific rule governs that situation.
32. Definitions In addition to "User Content", which is defined in Section 5, the following terms have the meanings given here: - "User" means any individual who accesses or uses the Service. - "Reference Photos" means photographs you upload so that the Service can generate images depicting you. - "Generated Images" means images produced through the Service based on Reference Photos, prompts, selected scenes, or other instructions you give. - "Credits" means the digital usage balance purchased or otherwise allocated to your account and used to generate images or access paid functionality.
The Privacy Policy and the Refund Policy, as updated from time to time, form an integral part of these Terms.
33. Account Security, Accuracy, and Transfer You undertake to provide true, accurate, complete, and up-to-date information when creating or using an account.
You may not create an account in the name of another person, impersonate another person, or access another user's account without authorization.
You are responsible for keeping your login credentials confidential and for all activity carried out through your account, except to the extent applicable law provides otherwise. You must notify us without undue delay at support@cmein.com if you become aware of any unauthorized access to or use of your account.
An account, and the Credits associated with it, may not be transferred, sold, or made available to another person except where we expressly permit it.
34. Ownership of Your Content, and the Licence You Give Us You retain ownership of the User Content you submit. Uploading content to the Service does not transfer ownership of it to CMeIn.
You grant CMeIn a limited, non-exclusive, worldwide licence to host, store, reproduce, process, modify, and transmit your User Content solely to the extent reasonably necessary to operate and provide the Service, generate the images you request, provide support, and comply with applicable law.
This licence does not transfer ownership, and it ends when the relevant content is deleted — subject to reasonable technical retention, backups, and legal obligations as described in the Privacy Policy and in Section 14.
35. Generated Images: Use, Uniqueness, and Rights Subject to these Terms and to any rights of third parties, you may use Generated Images created through your account for personal and commercial purposes. CMeIn does not claim ownership of your Generated Images.
Because of the nature of artificial intelligence systems, Generated Images may not be unique, and the same or similar content may be generated for other users.
CMeIn does not represent or warrant that any Generated Image is eligible for copyright protection, that you will obtain exclusive rights in it, or that its use will not require consideration of third-party rights in particular circumstances.
You are responsible for reviewing Generated Images and for determining whether your intended use complies with applicable law, the rights of third parties, and the rules of any third-party platform on which you use the images.
36. Artificial Intelligence and the Nature of Generated Results The Service uses artificial intelligence and machine-learning technologies. Generated Images are produced automatically from Reference Photos, prompts, selected scenes, and other inputs, and may contain errors, artifacts, inaccuracies, or unexpected results.
CMeIn does not guarantee that a Generated Image will accurately reproduce every facial feature, physical characteristic, item, location, or other element you requested. Results may vary between requests even where similar Reference Photos or prompts are used.
You acknowledge that the Service is intended to generate visual content, and that a Generated Image must not be relied upon as an accurate record of an actual event, location, activity, or circumstance. It is not evidence that anything depicted in it took place.
37. Nature of Credits and Corrections to a Balance Credits are a contractual right to use designated functionality of the Service. Credits are not legal tender, electronic money, or a deposit, have no cash value outside the Service, and may not be sold or transferred except where we expressly permit it.
Unless expressly stated otherwise, the Service does not operate on a recurring subscription basis, and purchasing a Credit package does not create a recurring payment obligation.
Credits are deducted when the applicable image-generation request is submitted or processed, as shown in the Service interface.
Promotional, bonus, or complimentary Credits have no cash value and may carry additional conditions, including expiry or usage limits.
CMeIn may correct a Credit balance where reasonably necessary to rectify an error, a duplicate allocation, a chargeback, a refund, fraud, or abuse — provided that this does not affect rights you have under mandatory consumer law.
38. Marketing Communications Subject to applicable law, CMeIn may send marketing communications about its Service, features, offers, and promotions. Where consent is required by law, such communications will be sent only after that consent has been obtained.
You may opt out of marketing communications at any time using the unsubscribe mechanism in the communication, or by contacting support@cmein.com. Opting out does not stop the operational, transactional, and security communications described in Section 29, which continue for as long as your account is active.
39. Third-Party Services and Dependencies The Service relies on, and may interface with, third-party services — including artificial intelligence providers, cloud infrastructure providers, payment processors, analytics providers, authentication providers, the Apple App Store, and Google Play.
CMeIn does not control these services and does not guarantee their continued availability, performance, or compatibility with the Service. Your use of them may also be subject to that third party's own terms of service and privacy policy.
Payments may be processed by external payment processors or, for in-app purchases, by the Apple App Store or Google Play, and such purchases may be subject to that platform's terms and policies. Refunds for purchases made through those stores may have to be processed through that store's own refund procedure.
40. CMeIn's Intellectual Property All intellectual property rights in the Service — including software, source and object code, algorithms, models and model-related implementations owned by CMeIn, interfaces, workflows, databases, design, graphics, trademarks, logos, texts, and documentation — are owned by CMeIn or its licensors.
Subject to these Terms, CMeIn grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service. Except for User Content and Generated Images as expressly provided in these Terms, no right or licence in CMeIn's intellectual property is granted to you.
You may not copy, reproduce, distribute, sell, licence, reverse engineer, or commercially exploit the Service or any proprietary component of it, except as expressly permitted by these Terms or by applicable law.
41. Statistical and Anonymised Information CMeIn may create and use statistical, aggregated, or anonymised information derived from use of the Service, where that information does not reasonably identify an individual — including for analytics, research, security, service improvement, and business planning, subject to applicable law.
42. General Provisions If CMeIn does not exercise or enforce a right under these Terms, that is not a waiver of the right.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
You may not assign or transfer your rights or obligations under these Terms without CMeIn's prior written consent. CMeIn may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or transfer of the Service, subject to applicable law.
Section headings are for convenience only and do not affect the interpretation of these Terms.
These Terms, together with the Privacy Policy, the Refund Policy, and any additional terms expressly applicable to a particular feature or purchase, constitute the agreement between you and CMeIn regarding your use of the Service.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
43. Further Prohibited Uses In addition to the prohibited uses listed in Section 10, you may not use the Service: - To introduce malware, or otherwise interfere with the operation or the security of the Service. - To engage in fraud, identity theft, extortion, manipulation, or other deceptive conduct. - To circumvent technical, security, payment, or usage restrictions — including any attempt to obtain Credits, generations, or paid functionality without paying for them. - To decompile the Service or attempt to discover its source code or underlying components, except to the extent that this restriction is prohibited by applicable law.
44. Changes to Credit Costs Do Not Reach Backwards CMeIn may change the number of Credits required for future generations or for other paid functionality.
Such a change does not retroactively alter a purchase you have already completed, except where these Terms expressly permit it or where a correction of an error requires it. Credits you have already bought remain usable on the terms that applied when you bought them.
45. Suspension, Termination, and What Survives Where it is reasonably necessary to prevent harm, fraud, unlawful use, or a security risk, CMeIn may suspend or limit an account without prior notice. Otherwise we will give notice where it is reasonable and lawful to do so.
You may stop using the Service and request deletion of your account at any time, subject to outstanding transactions, any refund rights that apply, and information CMeIn is permitted or required to retain as described in Section 14 and in the Privacy Policy.
Termination does not affect rights or obligations that arose before it. Sections that by their nature are intended to survive — including Sections 22, 23, 27, 28, 40, and this Section — continue to apply after your account is closed.
CMeIn may discontinue all or part of the Service for legitimate business, technical, or legal reasons, subject to any notice or refund rights required by applicable law.
46. Third-Party Failures, and What Platforms Do With Your Images CMeIn is not responsible for interruptions, delays, or failures caused by third-party AI providers, hosting providers, payment processors, application stores, internet infrastructure, or other circumstances outside its reasonable control.
CMeIn is also not responsible for your publication, distribution, or use of Generated Images on third-party websites, social networks, dating platforms, or other services — or for any action such a platform takes in accordance with its own rules, including removing an image, restricting an account, or refusing to accept a photograph.
47. Your Opportunity to Respond to a Claim Where CMeIn seeks indemnification from you under Section 23, we will notify you of the claim and give you a reasonable opportunity to respond to it, where doing so is appropriate in the circumstances and permitted by law. This does not limit CMeIn's right to defend a claim made against it.
48. Clarifications to Sections 2, 5, 7, and 25 For the avoidance of doubt:
Age (Section 2). By creating an account or using the Service, you represent and warrant that you are at least 18 years old, or the age of legal majority in your jurisdiction if that age is higher.
User Content (Section 5). You represent and warrant that your User Content does not infringe any copyright, privacy right, publicity right, trademark, confidentiality obligation, or other right of any third party. This is a representation you make to CMeIn, and you remain responsible for it.
Technical failures (Section 7). Where a generation materially fails because of a technical issue attributable to the Service — as distinct from unsuitable reference photos, prompt choices, or policy violations — CMeIn may provide replacement or retry Credits, in accordance with the Refund Policy. Section 7's per-account cap does not apply to failures of this kind.
Governing law (Section 25). Israeli law applies without regard to its conflict-of-law principles.
